Terms of Use
Effective April 14, 2026
1. Acceptance
By installing the PDMCGuard daemon, accessing the dashboard at pdmcguard.com, or using any related API, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the service. These Terms are between you and pragmaticdevs ("we", "us", "our").
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to install and use the PDMCGuard daemon and dashboard for your internal security monitoring purposes. The daemon's source code is licensed separately under the terms specified in the GitHub repository. No other rights are granted.
3. Account Responsibilities
You are responsible for:
- Keeping your credentials secure and not sharing them with third parties.
- All activity that occurs under your account, including use by any daemon instances you register.
- Ensuring the machines running the PDMCGuard daemon are authorized to sync data to your account.
- Promptly notifying us of any unauthorized access at security@pragmaticdevs.com.
4. Prohibited Use
You may not use PDMCGuard to:
- Resell, sublicense, or redistribute the service to third parties.
- Reverse-engineer, decompile, or attempt to extract source code from the cloud components.
- Use the service to monitor systems you do not own or have authorization to monitor.
- Attempt to circumvent rate limits, access controls, or authentication mechanisms.
- Violate any applicable law or regulation.
5. Payment Terms
Paid plans are billed monthly or annually in advance via Stripe. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
6. Service Availability
We aim for high availability but do not guarantee uninterrupted access. The daemon includes a local advisory cache so basic alerting continues to function during cloud outages. We are not liable for losses resulting from service unavailability.
7. Disclaimer of Warranties
PDMCGuard is provided "as is" without warranty of any kind. We do not warrant that the service will detect all vulnerabilities or that advisory data will be complete or error-free. Security monitoring is one layer of defense and should not be your only safeguard.
8. Limitation of Liability
To the maximum extent permitted by applicable law, pragmaticdevs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of PDMCGuard, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
Either party may terminate at any time. You may cancel your subscription via the billing settings in the dashboard. We may suspend or terminate your account for violation of these Terms, non-payment, or any other reason with reasonable notice where practicable.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which pragmaticdevs is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or an in-dashboard notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
